Can Foreigners Buy Property in Mexico? Fideicomiso Explained

Can foreigners buy property in Mexico? Yes. Learn how fideicomiso works for coastal property and what international buyers should verify.

Yes. Foreign buyers can acquire property interests in Mexico. In coastal destinations, however, the ownership structure is different from buying in many European, Canadian or U.S. markets.

What is the restricted zone?

The SRE defines the restricted zone as land within 100 kilometers of Mexico’s borders and 50 kilometers of its beaches. Foreigners cannot hold direct title to land in that zone for residential use, but the Foreign Investment Law allows use and enjoyment through a fideicomiso.

What does the bank actually do?

The bank acts as trustee. The foreign buyer is the beneficiary and the trust instrument establishes the beneficial rights over the property. A fideicomiso should not be confused with renting the property from the bank. The SRE states that permits can be granted for a maximum term of 50 years.

Questions to ask before signing

  • Which bank will act as trustee?
  • What are the bank’s setup and annual administration fees?
  • Who is preparing and reviewing the trust documents?
  • Who will be named as substitute/successor beneficiaries?
  • What is the expected closing timeline?
  • Are all property and seller documents ready for the notarial process?

Fees and procedures change, so use current written quotations rather than an old blog post or a salesperson’s memory. The same applies to government charges and notarial estimates.
