How to Avoid Real Estate Scams in Mexico: Foreign Buyer Guide

How foreign buyers can reduce real estate fraud risk in Mexico by verifying professionals, property documents, contracts and payment instructions.

Fraud prevention should not begin when something feels wrong. It should be built into the transaction from the first conversation.

Red flag 1: pressure replaces documentation

A legitimate commercial deadline can exist. But “send the money now and we will explain later” is not a substitute for verified documents, clear refund terms and confirmed payment instructions.

Red flag 2: the recipient of the money is unclear

Know who is legally receiving the reservation, deposit or purchase payment and why. Confirm bank details through a trusted channel, particularly if instructions change unexpectedly.

Red flag 3: guaranteed returns without a clear guarantor

Ask who is guaranteeing the payment, under what contract, for how long, under what conditions and from what financial capacity. A marketing projection is not a guarantee.

Red flag 4: resistance to independent review

Independent legal/notarial review should not be treated as hostility toward the seller. It is normal risk management for a high-value transaction.

Red flag 5: unverifiable professional credentials

Quintana Roo’s current real estate services law requires accreditation for those providing regulated real estate services and provides for a public registry framework. Verify the person and role you are relying on.

SAT also treats real estate development/intermediation and certain related professional activities as vulnerable activities under anti-money-laundering law. Requests for proper identification and compliance documentation are therefore not, by themselves, suspicious.
