Buying Property in Mexico as a Foreigner: 2026 Guide

How foreigners can buy property in Mexico in 2026, including the restricted zone, fideicomiso, due diligence, contracts and closing.

Foreigners can buy real estate in Mexico. The key question is not whether you can buy, but which legal structure applies to the property you are buying.

Article 27 of the Mexican Constitution restricts direct foreign ownership within 100 kilometers of an international border and 50 kilometers of the coastline. Because Playa del Carmen, Tulum, Cancún and the Riviera Maya are coastal, foreign residential buyers in these areas commonly acquire beneficial rights through a bank trust known as a fideicomiso. The SRE states that these restricted-zone trusts may be authorized for up to 50 years and must be formalized in a public deed.

A practical buying sequence

  1. Define budget, intended use and preferred market.
  2. Compare suitable properties across pre-construction, ready and resale inventory.
  3. Understand any reservation deposit before sending funds.
  4. Have the property, seller/developer and contract reviewed.
  5. Confirm the fideicomiso and notarial structure where applicable.
  6. Complete payments and closing only according to verified written instructions.
  7. Plan HOA, insurance, management, utilities and tax compliance after closing.

What a foreign buyer should never assume

Do not assume every contract is standard, every developer has the same track record, every reservation is refundable, or every projected rental return is realistic. Mexico has consumer-protection rules for residential real estate marketing and contracts, including NOM-247-SE-2021, but buyers still need property-specific review.

The most efficient approach is to separate roles: your real estate representative helps you search and compare; independent legal/notarial professionals verify the legal transaction; tax and accounting professionals advise on your specific tax position.

Next step

If you are buying from abroad, EMEXA can conduct the property search, comparison and on-the-ground coordination while independent professionals handle specialized legal and tax advice.
