Buying Pre-Construction Property in Mexico: Risks & Due Diligence

Buying pre-construction property in Mexico? Understand developer risk, contracts, payment plans, delivery and due diligence before committing.

Pre-construction can be compelling because timing can work in the buyer’s favor: earlier pricing, payment plans and more choice. But the same timing creates the central risk - you are committing capital before the finished product exists.

Why early pricing exists

Developers often use staged sales and buyer payments as part of the project’s commercial and financing structure. In return for committing earlier, buyers may receive preferential pricing, incentives or payment schedules. That does not mean appreciation is guaranteed. The value of entering early depends on the project being delivered, the market supporting the finished price and the unit remaining competitive.

Due diligence should answer these questions

  • Who is the legal seller and what rights does it have over the project/property?
  • What relevant permits, authorizations and project documents exist?
  • What has this developer actually delivered before?
  • What does the contract say about delivery, extensions, default and cancellation?
  • Where are payments being sent and to which legal entity?
  • What exactly is included in the unit and common areas?
  • How much competing inventory may be delivered around the same time?

NOM-247-SE-2021 is relevant to residential real estate marketing and contracts in Mexico, and PROFECO maintains systems for registered adhesion contracts. That regulatory framework is useful, but it does not replace independent review of the specific project and agreement.
